These Terms and Conditions (“
Terms”) govern your access to and use of the MissedCall Plumber website, software, and services (collectively, the “
Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
MissedCall Plumber provides a software-as-a-service platform that enables businesses to send automated, transactional SMS messages in response to inbound phone calls that are not answered. The Service is intended for
business use only.
2. Eligibility
You represent that:
-You are at least 18 years old.
-You are authorized to bind the business you represent.
-You will use the Service in compliance with all applicable laws and regulations.
3. Account Registration
To use the Service, you must create an account and provide accurate, current, and complete information. You are responsible for:
-Maintaining the confidentiality of your account credentials.
-All activity that occurs under your account.
4. Acceptable Use
You agree
not to use the Service to:
-Send marketing, promotional, or bulk messages.
-Send messages without lawful consent.
-Send content that is unlawful, abusive, misleading, or fraudulent.
-Violate carrier, CTIA, or telecommunications rules.
-Interfere with or disrupt the Service.
MissedCall Plumber reserves the right to suspend or terminate accounts that violate these Terms.
5. Messaging and Consent
You acknowledge and agree that:
-The Service sends
transactional, service-related SMS messages only.-Messages are sent
only in response to inbound phone calls initiated by end users.-You are responsible for ensuring that your use of the Service complies with applicable consent and messaging laws.
-All messages include opt-out instructions (e.g., “Reply STOP to opt out”).
-MissedCall Plumber does not provide legal advice regarding messaging compliance.
6. Subscriptions and Billing
a. Subscription Fees
The Service is offered on a subscription basis. Fees are billed in advance on a monthly basis unless otherwise stated.
b. Payment Processing
Payments are processed by a third-party payment processor. By subscribing, you authorize recurring charges to your selected payment method.
c. Taxes
Prices may exclude applicable taxes. You are responsible for any taxes associated with your subscription.
d. Cancellation
You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing period. No refunds are provided for partial billing periods.
7. Service Availability
While we strive to provide reliable service, MissedCall Plumber does not guarantee uninterrupted or error-free operation. Service delivery may depend on third-party providers, including telecommunications carriers.
8. Third-Party Services
The Service relies on third-party services (such as messaging and payment providers). MissedCall Plumber is not responsible for outages, delays, or failures caused by third parties.
9. Intellectual Property
All rights, title, and interest in the Service, including software, content, and branding, are owned by MissedCall Plumber or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes during your subscription term.
10. Disclaimer of Warranties
The Service is provided
“as is” and
“as available.” MissedCall Plumber disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the maximum extent permitted by law, MissedCall Plumber shall not be liable for any indirect, incidental, consequential, or special damages, including lost profits or lost data. MissedCall Plumber’s total liability shall not exceed the amount paid by you for the Service in the twelve (12) months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless MissedCall Plumber from any claims, damages, losses, or expenses arising out of your use of the Service, including violations of messaging or consent laws.
13. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or applicable law. Upon termination, your right to use the Service will immediately cease.
14. 30-Day Money-Back GuaranteeMissedCall Plumber offers a 30-day money-back guarantee to new subscribers on all plans (the "Guarantee"). The following terms govern eligibility and claims.
a. Guarantee PeriodThe Guarantee period begins on the date of your first payment ("Guarantee Period") and expires at 11:59 PM CT on the 30th calendar day thereafter. Claims submitted after this window will not be honored.
b. What "Recovery" MeansFor purposes of this Guarantee, a missed call is considered
successfully recovered when MissedCall Plumber's automated system detects a missed inbound call to your configured business phone number and transmits at least one SMS message to that caller's number within the system's automated response window. Recovery does not require that the caller reply to the SMS, re-engage, schedule a job, or generate revenue. The sole condition is that the system successfully dispatches an outbound SMS in response to a missed call event.
c. Eligibility ConditionsTo be eligible for a refund under this Guarantee, all of the following must be true:You are a first-time subscriber and have not previously received a refund from MissedCall Plumber under any plan; Your Twilio-powered phone integration was properly configured and active during the Guarantee Period; Your business received at least one inbound phone call during the Guarantee Period that went unanswered; The system did
not successfully dispatch an SMS in response to any such missed call during the Guarantee Period; and You submit a written refund request to
support@missedcallplumber.com before the Guarantee Period expires, including your account name, registered phone number, and a brief description of the issue.
c. Refund AmountIf a valid claim is approved, MissedCall Plumber will refund your first month's subscription payment in full. Refunds do not include any Twilio messaging fees, setup fees, or payments made after the first billing cycle. Refunds are issued to the original payment method within 5–10 business days of approval.
d. ExclusionsThe Guarantee does not apply if: Your phone system, carrier, or forwarding configuration prevented calls or missed call signals from reaching the MissedCall Plumber system; You did not receive any inbound calls during the Guarantee Period; Your account was suspended or deactivated for any reason during the Guarantee Period; You are upgrading, downgrading, or switching between plans rather than subscribing for the first time.
e. LimitationThis Guarantee is offered once per customer, per business entity, and per phone number. MissedCall Plumber reserves the right to deny claims that show evidence of abuse or manipulation of the Guarantee terms.
15. Changes to These Terms
We may update these Terms from time to time. Changes will be effective when posted with an updated “Last updated” date. Your continued use of the Service constitutes acceptance of the revised Terms.
16. Governing Law
These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law principles.
